Terms of Engagement
These terms, apply to all services that The Secret Service Limited provide to you (the client) anytime
whether now or in the future. These always apply except when we have expressly stated otherwise in writing.
You agree that by engaging The Secret Service to provide services to you, you accept the terms and conditions
set out below:

Confidentiality

The client authorises The Secret Service to collect, retain, disclose and use any information about them and their business for the purpose of assessing the client's needs, sending invoices, recovering money owed or enforcing any rights under this contract.

Secret Service will give the client access to and, at their request, correct any information it holds about the client.

With the exception of any confidential Information without prior approval, the client agrees to allow The Secret Service to use the information they hold about the client, and may exchange this information with The Secret Service’s contractors, agents, representatives, carriers, and with credit reporting and debt collection agencies.

Price

services shall be deemed to be sold at the current amount as such services are sold or provided by The Secret Service at the time of execution of the contract.

The price may be increased by the amount of any reasonable increase in the cost of supply of the goods or services that is beyond the control of The Secret Service between the date of the contract and delivery of the goods or providing of the services.

Delivery

Conficlient is responsible for risk in the goods from the earlier of the time they are received by a carrier for delivery to the client, or the time they are received by the client or their agent.dentiality

The client agrees to pay all delivery costs.

The client does not have the right to possess goods until they are delivered to, or collected by the client. Where the client asks The Secret Service to deliver goods directly to another person, that person takes possession of the goods for the client as their agent.

All claims for shortage or delivery damage must be made to the carrier and to The Secret Service within 3 business days of the date of delivery.

The Secret Service will make every effort to ensure delivery of goods, or performance of services, is on time, but will not be liable to the client for any loss or damage arising in any way from any delay in delivery or performance.

Payment Terms

Confirmation of a booking or product is only certain once payment has been received in full by The Secret Service Ltd.

Payment for goods and/or services shall be made in full on or before the due date of the supplied Tax Invoice.

All charges are in New Zealand dollars and are inclusive of all taxes and duties.

Any expenses, disbursements and legal costs incurred by The Secret Service in the enforcement of any rights contained in this contract shall be paid by the client, including any reasonable solicitor's fees or debt collection agency fees.

Limit of Liability

All due care will be taken by The Secret Service to ensure accuracy of information and quality of experience, however the final responsibility rests with the client. To the extent permitted by the laws of New Zealand, The Secret Service accepts no liability on any grounds for consequential damages or losses arising from any cause, including omission or negligence.

Cancellation

In the event you want to change a booking the Secret service will do there best to reschedule your experience. You will not be entitled for an exchange for changes of mind or cancellation for personal reasons.

The Secret Service does not guarantee the availability of any of the activities advertised on the website. In the event that an activity becomes unavailable on an advertised date or the activity needs to be cancelled for any reason apart from weather, you will be re-booked at no cost to you. All reasonable steps will be taken to accommodate you on an alternative date for that activity or an alternative date for a similar activity.

of the activities are weather dependent. You will have the Secret Services details so you can check if services are affected by bad weather on the day or ahead of your booking. If bad weather affects a booking it will be re-booked at no cost to you. All reasonable steps will be taken to accommodate you on an alternative date.

Applicable Laws

All work is governed by the laws of New Zealand and the Courts of New Zealand shall have the sole and exclusive jurisdiction to hear and determine all disputes in connection with claims arising from work produced by The Secret Service.

The guarantees contained in the Consumer Guarantees Act 1993 are excluded where the client acquires goods or services from The Secret Service for the purposes of a business in terms of section 2 and 43 of that Act.
